JamesRPGArt Commercial Licensing Information
Effective date: June 23, 2026. These terms govern all commercial licenses granted on or after this date. Licenses granted under earlier terms remain governed by the terms in effect at the time of purchase, unless you choose to adopt these updated terms. If you are an existing licensee and want to continue under these updated terms, no action is needed. If you are unsure which terms apply to you, contact me at jamesrpgart@gmail.com.
This page covers two ways to license my work for commercial use:
Direct Commercial License. A one-time license purchased for a specific use. See the General Terms below.
Patreon Subscription Licenses. Commercial allowances tied to an active Patreon membership. See the Patreon section below.
The General Terms of Use apply to every license on this page. The Patreon section adds tier-specific allowances on top of those General Terms. Where a Patreon tier states something different from the General Terms, the tier wording controls for that tier.
Definitions
Licensor, "I", "me", "my" means JamesRPGArt.
Licensee, "you", "your" means the individual or entity acquiring a license.
Scene(s) means any artwork or asset I sell or distribute, including animated scenes, static scenes, and scene packs, together with all individual files that make them up.
Agreement means these licensing terms, including any tier-specific terms that apply to your license.
Published or Released means anything you create or distribute for financial gain, including products for sale, subscriber or backer rewards, and promotional material. Content you post purely for fun, with no financial purpose, is not considered Published or Released, but still requires attribution and must never include my patron-exclusive content.
General Terms of Use
Grant of license. Once your license is active, whether by payment of the applicable fee or by an active Patreon membership, I grant you a non-exclusive, non-transferable, worldwide license to use each licensed Scene for commercial purposes, subject to this Agreement.
Permitted use. You may display, distribute, and use the Scenes only as part of a larger product, service, or experience. This includes virtual tabletop platforms, tabletop role-playing sessions, digital events or campaigns, and streamed, recorded, or promotional content.
Ownership. All right, title, and interest in the Scenes remain solely with me. This Agreement grants a license only and does not transfer ownership of any intellectual property.
Modifications. You may resize, crop, recolor, or composite the Scenes as needed to fit your product, provided the result is still used as part of a larger product and not distributed as a standalone asset. Attribution still applies to modified versions. You may not modify a Scene in a way that misrepresents it as your own original artwork.
Restrictions. You may not:
sell, sublicense, share, or redistribute the Scenes, modified or unmodified, as standalone files or assets;
claim authorship or ownership of the Scenes;
use the Scenes in any unlawful, defamatory, or infringing manner;
share the original files with any third party outside the licensed use;
use the Scenes, in whole or in part, to train, fine-tune, or develop any artificial intelligence or machine-learning model or dataset;
mint, sell, or distribute the Scenes as NFTs or other blockchain-based tokens.
Attribution. You must credit me on every commercial use, as set out in the Attribution section below.
Term and termination. Your license remains in effect for as long as it is valid (the paid term for a Direct Commercial License, or your active membership period for a Patreon license). I may terminate your license only if you breach this Agreement and fail to correct the breach within 14 days of written notice. On termination for breach, you must stop all use of the Scenes.
Sell-through. If your license ends for any reason other than a breach you did not correct, any product you Published or Released in good faith while your license was active may continue to be sold and used, subject to attribution and all restrictions in this Agreement. You may not create or Release new products using the Scenes after your license ends.
No warranty. The Scenes are provided "as is", without warranties of any kind, express or implied.
Limitation of liability. I am not liable for any indirect, incidental, or consequential damages arising from use of the Scenes.
Governing law. This Agreement is governed by and construed under the laws of the Province of British Columbia and the applicable laws of Canada.
Severability. If any provision of this Agreement is found unenforceable, the remaining provisions stay in full effect.
Entire agreement. This Agreement, together with any tier-specific terms that apply to your license, is the entire agreement between you and me regarding the licensed Scenes, and supersedes any prior understanding.
Acceptance. By purchasing or using a licensed Scene, you confirm that you have read, understood, and agreed to this Agreement.
Attribution
Every license requires credit. Please do the following:
Credit line. Include my name in your product's credits as the artist or a similar title, for example "Art by JamesRPGArt" or "Scene Art by JamesRPGArt".
Digital products. Include a link to my website: https://www.jamesrpgart.com/. If your product has a listing on a digital marketplace, the credit and link must also appear in the product description.
Physical products. A clickable link is not possible in print, so include my name and the website address in text, for example "Scene Art by JamesRPGArt, jamesrpgart.com".
How to get a Direct Commercial License
A Direct Commercial License is a one-time license for a specific product or use. Fees depend on the scope of use. To request one, contact me at jamesrpgart@gmail.com with a short description of how you plan to use the Scenes, and I will send you a quote and license confirmation.
Patreon Subscription Licenses
These licenses give you commercial allowances for as long as your Patreon membership qualifies. They build on the General Terms above.
Patreon Specific Terms of Use
Active membership required. Except where a tier states otherwise, your commercial allowances apply only while your qualifying membership is active. If your membership ends, your ability to create or Release new commercial content using the Scenes ends at the same time.
Sell-through after cancellation. When your membership ends, content you already Published or Released while your membership was active may continue to be sold or remain online, unless a tier states otherwise, subject to attribution and all restrictions. You may not create or Release new content using the Scenes once your membership ends.
Free and pay-what-you-want content. Promotional content you Release for free, and content offered on a pay-what-you-want basis, is still considered commercial content and is bound by these terms.
Patron-exclusive content. You may never share or redistribute my patron-exclusive content, regardless of tier or membership status.
Check the allowances for each tier below.
Dungeon Master Tier
Commercial License - Streaming and ‘GM for Hire’ Games
You may use any of my Scenes in games that you stream or record and publish online.
You may use any of my Scenes in games that you charge to run (GM for hire).
You must remain an active member of the Dungeon Master tier for these allowances to apply.
You must credit me on the stream, during the game, or in the description.
If your membership ends, recordings and streams already published may stay online, but you may not run new paid or streamed games using the Scenes until you rejoin.
Patron of Legends Tier
Commercial License - Use of Scenes
This tier requires a one-year subscription to the Patron of Legends tier, renewed annually for the commercial license to remain active.
While active, you may use any of my Scenes for commercial purposes in digital and physical products.
You may also use any of my Scenes in games that you stream, record, or charge to run (GM for hire).
Usage cap. You may publish up to 5,000 units per individual product. If you expect to exceed this for any product, contact me for a higher-volume Direct Commercial License before publishing.
If you cancel, your commercial license remains in effect until the expiry date of your current paid year. Products you Published or Released during an active license may continue to be sold after expiry under the sell-through terms above. You may not create or Release new products using the Scenes after your license expires unless you renew.
The Scenes may not be sold, sublicensed, shared, or redistributed as standalone assets.
